Dear Sir/Madam

1. ECHO would like to procure the service mentioned above. We are sending you the tender specifications along with a list of the documents you need to send to make an offer, and the draft contract.

2. If you want to sell us this service, you should send us your offer by electronic mail not later than May 02 2023 to Echo-Administration.Abuja@echofield.eu.

3. Your offer must:

• be signed by your legal representative (or yourself if you are bidding as a private person);

• be easy to read so there is no doubt as to words and figures;

• include your technical offer (Annex II);

• include your financial offer (Annex III) in NGN without all duties, taxes and other charges such as VAT, as ECHO is exempt from these taxes. The amount of VAT may be shown separately;

• include the identification and capacity form (Annex V) and the signed declaration on honour (Annex VI).

• include the LEF and the BAF (Annex VII)

4. The period of time that your offer is valid without any changes allowed is 60 days from the closing date in Point 2 above.

5. Only invited tenderers are eligible to participate in this procurement procedure.

6. When you make an offer, it means you agree to all the terms and conditions set out in this invitation to tender, in the tender specification and in the draft contract. It also means you waive your own conditions and agree to use only the ECHO conditions. The service/supply described in the offer you submit is what you have to legally provide during the whole period of validity of the contract signed afterwards.

7. ECHO reserves the right to negotiate with the tenderers during the evaluation phase. The negotiation cannot modify the minimum requirements and the exclusion and selection criteria. On the contrary, what is not defined as minimum requirements in the tender specifications may be negotiated. ECHO may negotiate to improve the quality and/or the price.

8. ECHO will not award a contract to tenderers who:

• are subject to a conflict of interests;

• are guilty of misrepresenting the information required by ECHO as a condition of participation in the procurement procedure or fail to supply that information; (the information provided turns out not to be true)

• find themselves in one of the situations of exclusion, referred to in Annex V, for the procurement procedure.

9. Submitting an offer does not mean that ECHO will sign a contract with you. The invitation to tender is in no way binding on ECHO. A contractual relationship only begins when ECHO signs a contract or purchase order.

If processing your reply to the invitation to tender involves the recording and processing of personal data (such as your name, address and CV), such data will be processed pursuant to Regulation (EC) No 2018/1725 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data. Unless indicated otherwise, your replies to the questions and any personal data requested are required to evaluate your tender in accordance with the specifications of the invitation to tender and will be processed solely for that purpose by the Head of Unit of the unit in charge of legal affairs of Directorate-General for European Civil Protection and Humanitarian Aid Operations. 10.
