ILO Governing Body 340th session - EU Statement INS 15: Complaint concerning the non-observance by Chile

I speak on behalf of the European Union and its Member States. The Candidate Country the Republic of North Macedonia*, Montenegro* and Albania* and the EFTA country Norway, member of the European Economic Area, align themselves with this statement.

We thank the Office for the document GB.340/INS/15 and acknowledge the reply and observations of the Government of Chile contained therein.  

We note that the complaint does not explicitly or comprehensively reference violations of ILO Conventions 103, 135 or 151 in the body of the text and covers issues similar to a complaint introduced in 2016.

We note that the Commitee of Experts on the Application of Conventions and Recommendations acknowledged with satisfaction the advances of Act No. 20.940, in force since 2017, and the labour reform  as regards the application in law and practice of ILO Conventions dealing with the labour relations subject of the complaint.

We therefore consider that, similarly to 2016, the elements invoked in the complaint do not correspond to allegations whose examination are to be undertaken under Article 26 of the ILO Constitution and be subject of a Commission of Inquiry.
