The Parliamentary Assembly of the Council of Europe debates EU accession to the European Convention of Human Rights

The Parliamentary Assembly of the Council of Europe discussed a report prepared by Romanian parliamentarian Titus CORLĂŢEAN and adopted a resolution on the legal aspects of the accession of the European Union (EU) to the European Convention on Human Rights (ECHR). 

The resolution invites EU institutions, in particular the EU Commission and the Council of the European Union, to submit a request for an opinion on the compatibility of the revised draft accession instruments with the European Union Treaties to the Court of Justice of the European Union (CJEU) without delay, and, if the opinion is positive, to proceed with the conclusion of the agreement as soon as possible in accordance with their internal procedures. 

The resolution also underlines that the draft agreement accommodates the CJEU's position on the specificities of EU law, while preserving the integrity of the ECHR system and the role of the Court.

Numerous parliamentarians highlighted that the EU accession will provide all people living in EU Member States with additional remedies and judicial guarantees in case their human rights might be infringed by EU institutions. 

Regarding specific concerns, Mr CORLĂŢEAN emphasised the important role for the principles of subsidiarity and of the margin of appreciation of states within the ECHR system, and that the EU accession would ensure avoiding duplication and contradictory jurisprudence solutions from the CJEU and the European Court of Human Rights.
